Overview
Changing from B-1/B-2 visitor status to F-1 student status allows tourists or business visitors to become full-time students in the United States. While this process is possible, it requires careful timing and attention to USCIS rules.
Eligibility Requirements
To change from B-1/B-2 to F-1, you must:
- Have been lawfully admitted to the U.S. in B-1 or B-2 status
- Your B status must still be valid (not expired)
- You have not violated the terms of your B status
- You have not worked illegally in the U.S.
- You are not subject to the 2-year home residency requirement
- You have been accepted by a SEVP-certified school
Step-by-Step Process
- Get accepted to a school: Apply and receive acceptance from a SEVP-certified institution
- Obtain Form I-20: Contact the school’s DSO (Designated School Official) to issue your I-20
- Pay SEVIS Fee: Pay the I-901 SEVIS fee ($350) at fmjfee.com
- Prepare documents: Gather all required documents (see list below)
- File Form I-539: Submit online at USCIS.gov or by mail
- Pay filing fee: $420 (online) or $470 (paper)
- Wait for decision: Processing takes 6-12 months

| Form I-539 | Application to Extend/Change Nonimmigrant Status |

- Scholarships: Award letter from the school
- Government sponsorship: Letter from sponsoring government agency

| I-539 Filing Fee (Paper) | $470 |
| I-901 SEVIS Fee | $350 |
| Premium Processing (Optional) | $1,965 |
Processing Time
Standard processing takes approximately 6-12 months. During this time:
- You may remain in the U.S. while your application is pending
- You will receive a receipt notice (Form I-797C) within 2-3 weeks
- You CANNOT begin full-time studies until your F-1 status is approved
- Check your case status online at uscis.gov/casestatus
While Your Application Is Pending
- DO: Keep your passport valid, maintain a U.S. address, respond to USCIS requests promptly
- DON’T: Work without authorization, leave the U.S. (this will abandon your application), start full-time studies before approval
Common Reasons for Denial
- Filing too soon after entry (30/60 day rule)
- Insufficient financial evidence
- B status expired before filing
- Evidence of unauthorized employment
- Incomplete application or missing documents
- Prior immigration violations
Alternative: Consular Processing
Instead of changing status in the U.S., you can:
- Leave the United States
- Apply for an F-1 visa at a U.S. embassy/consulate in your home country
- Re-enter the U.S. on F-1 status
This option is faster (usually 2-4 weeks) but requires travel and a visa interview.
