What is EB-2 NIW?
The EB-2 National Interest Waiver (NIW) is a second-preference employment-based green card that waives the typical job offer and labor certification requirements. If you can demonstrate that your work benefits the national interest of the United States, you can self-petition without an employer sponsor.
The EB-2 NIW is particularly attractive for researchers, engineers, healthcare professionals, and entrepreneurs in STEM fields. The eligibility bar is lower than EB-1A, making it accessible to more professionals while still offering the independence of self-petitioning.

EB-2 NIW Eligibility Requirements
You must meet BOTH the educational requirements AND the three-prong national interest test:
Step 1: Advanced Degree Requirement
You must have ONE of the following:
- Master's degree or higher in your field of work
- Bachelor's degree + 5 years of progressive post-bachelor's work experience in your field
- Foreign degree equivalent to U.S. advanced degree (requires credential evaluation)
Step 2: Three-Prong National Interest Test (Matter of Dhanasar)
You must demonstrate ALL three prongs:
Substantial Merit & National Importance
Your proposed endeavor has substantial merit and national importance to the United States. This can be in fields like STEM, healthcare, education, business, culture, or any area that benefits America.
Well Positioned to Advance the Endeavor
You are well positioned to advance your proposed endeavor. This is demonstrated through your education, skills, knowledge, track record, plan for future activities, and progress achieved to date.
Beneficial to Waive Job Offer Requirement
On balance, it would be beneficial to the United States to waive the job offer and labor certification requirements. You must show it would be impractical to go through the traditional PERM labor certification process.
