USCIS reinstatement processing typically takes 4-8 months. Unfortunately, premium processing is not available for reinstatement applications. We'll help you track your case throughout the process.
Can I study while my reinstatement is pending?
Yes! Once you have a reinstatement I-20 from your school and have filed your reinstatement application with USCIS, you can continue studying while waiting for approval.
What are the requirements for reinstatement?
To be eligible for reinstatement, you must: (1) not have been out of status for more than 5 months, (2) not have a record of repeated violations, (3) be currently pursuing or intending to pursue a full course of study, (4) not have engaged in unauthorized employment, and (5) show the violation was beyond your control or that denial would cause extreme hardship.
Can I work while my reinstatement is pending?
No. You cannot work while your reinstatement application is pending with USCIS. Working without authorization could result in denial of your reinstatement and future immigration consequences.
Can I travel outside the U.S. while my reinstatement is pending?
No. If you leave the U.S. while your reinstatement application is pending, it will be considered abandoned. You would need to apply for a new F-1 visa at a U.S. embassy abroad, which may be difficult given your status violation history.
Do I need to switch to a new school for reinstatement?
Not necessarily. You can file for reinstatement with your current school if they're willing to issue you a reinstatement I-20. If not, or if you prefer a fresh start, we can help you get admitted to a new school from our partner network.
