The EB-1 visa category is a preference category for United States employment-based permanent residency. It is intended for “priority workers” with outstanding qualifications. The EB-1 category is divided into three sub-categories:
- This sub-category is for individuals who can demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. The achievements must be recognized through extensive documentation, and no offer of employment is required. Applicants must meet at least 3 of the following criteria or provide evidence of a one-time achievement (i.e., Pulitzer, Oscar, Olympic Medal):
- Receipt of lesser nationally or internationally recognized prizes or awards for excellence.
- Membership in associations in the field which demand outstanding achievement of their members.
- Published material about the person in professional or major trade publications or other major media.
- Participation on a panel, or individually, as a judge of the work of others in the same or an allied field.
- Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance.
- Authorship of scholarly articles in professional journals or other major media.
- Artistic exhibitions or showcases.
- Performance in a leading or critical role for organizations or establishments that have a distinguished reputation.
- High salary or other significantly high remuneration in relation to others in the field.
- Commercial successes in the performing arts.
- This sub-category requires applicants to demonstrate international recognition for their outstanding achievements in a particular academic field. They must have at least 3 years of experience in teaching or research in that academic area and must be entering the United States to pursue tenure or tenure track teaching or a comparable research position at a university or other institution of higher education. Evidence includes:
- Receipt of major prizes or awards for outstanding achievement.
- Membership in associations that require their members to demonstrate outstanding achievements.
- Published material in professional publications written by others about the applicant’s work.
- Participation as a judge of the work of others in the same or allied academic field.
- Original scientific or scholarly research contributions to the field.
- Authorship of scholarly books or articles in scholarly journals with international circulation.
This sub-category is for executives and managers who have been employed for at least one of the three preceding years by the overseas affiliate, parent, subsidiary, or branch of the U.S. employer. The applicant must be coming to work in a managerial or executive capacity. Requirements include:
